California Man Charged with Hit-and-run Busted during Giants-Dodgers Match

A Northern California man charged with hit-and-run resulting from a New Year’s eve’s pedestrian accident was busted during the San Francisco Giants and Los Angeles Dodgers baseball game.

According to reports, a beating incident during the game has led to the arrest of Christopher Torii Smith, 26, of Grass Valley, California.

The beating incident took place at the AT&T’s premise last September 9. Apparently, Smith approached a 21-year-old baseball fan at the comfort room and hit him several times. Shortly thereafter, Smith walked away from the scene but was arrested at the AT&T Park.

As a result of his beating, Smith was booked on suspicion of battery, vandalism, and public intoxication. Moreover, upon follow-up investigation, authorities discovered that he has a pending case of hit-and-run.

At present, Smith is waiting for his scheduled trial on two counts of felony resulting from the New Year’s eve’s hit-and-run incident.

According to deputy district attorney with Washoe, Michael Bolenbaker, Smith was arraigned last August 29 in Reno wherein he pleaded guilty to his charges. His trial is scheduled on May 20, 2013, Bolenbaker added.

Going back to Smith’s hit-and-run accident, previous reports claimed that Smith was driving a black 2006 Chevrolet pickup bound south along Highway 28, just east of Village Boulevard intersection last December 30, 2011. It was when his vehicle struck Linda S. Mathis and Robert C. Mathis, both 46, who were then crossing the street from the east side.

Both victims died from the incident due to their injuries sustained. Investigation on the incident revealed that Smith failed to yield to the pedestrians’ right of way.

Also, further reports claimed that Smith was driving under the influence of marijuana. In fact, based on his toxicology test during that time, the marijuana in his blood appeared to be greater than or equal to 5 nanograms per milliliter.

Unfortunately, right at this moment, it seems impossible to determine whether Smith was really under the influence of marijuana or if the marijuana was just in his system during the incident.

Apparently, that is likely to become Smith’s firm defense to somehow relieve himself from a heavier sentence, according to a Pedestrian accident lawyer.

Four Men Driving a Stolen Lexus Critically Injures a Woman Bystander

A pedestrian accident that occurred last February 7 involving a stolen Lexus left a woman in critical condition. The accident happened at around 7:30 in the evening at Bolsa Avenue just West of Beach Boulevard.

Witnesses have said that a white Lexus SUV – which was stolen according to the police, hit a woman standing by the side walk near a bus stop. The SUV was also found out to have further crashed into a power pole after hitting the woman.

The paramedics rushed the woman UC Irvine Medical Center for treatment of life-threatening injuries. Succeeding reports said that though the woman is in critical condition, she is now stable. The victim’s identity has not been disclosed by the authorities.

Witnesses have added that four men fled on foot from the accident scene. A perimeter, K9 dogs, and a helicopter were provided by the police to search for the suspects.  Two men near the scene were arrested and then released soon due to insufficient proof associating them with the incident.

The main cause of the accident was not yet determined. The police officials have said that if based upon the two detained suspects, there was no indication that alcohol is a factor to the incident. In addition, according to the investigation, the SUV was stolen from a home in Westminster that was burglarized last February 5.

Pedestrian accidents in California have become more rampant. Such accidents may result in to different injuries which can become serious and sometimes fatal. Pedestrian Struck and Killed by Car while Jaywalking

Pedestrians are required to use designated crosswalks to avoid being hit by approaching vehicles. The consequences of ignoring this rule may be seen in a fatal pedestrian accident that recently occurred in Pacoima.

According to reports, the male pedestrian may have been jaywalking when he was struck and killed by a vehicle along Laurel Canyon and Van Nuys boulevards.

The man was reportedly hit by a vehicle that was moving southbound along Laurel Canyon Boulevard.

Reports said the driver stopped and was interviewed by the police.

Authorities have made no arrests following the fatal accident.

The man is just one of the many pedestrians who were unfortunately killed while trying to cross the road. In fact, statistics show that at least 100,000 pedestrian accidents happen in the country. The worst part is that over 50% of these incidents result in fatalities.

These accidents may be avoided if both pedestrians and drivers will respect each other’s presence on the roads. Pedestrians can avoid being involved in an accident by using marked crosswalks. Meanwhile, drivers can avoid hitting pedestrians if they drive cautiously and avoid any kinds of distractions while out on the roads.

65-Year-Old man Killed in Concord Pedestrian Accident

A pedestrian accident in Concord claimed the life of one man the other day.

The Contra Cost Coroner’s office identified the victim as Jose Flores, 65 and a resident of Concord.

According to reports, Flores was trying to cross Clayton Road at Barbis Way at about 6pm when a Buick struck him.

Flores was in a crosswalk when the accident happened.

His family should consult with a wrongful death attorney to know if they can file a lawsuit against the driver of the Buick.

In the reports, there is a strong chance that Flores had the right of way before he was hit by the car.

The fact that he was on a crosswalk strongly indicates that as the case.

However, there are circumstances where even if the pedestrian was in a crosswalk, the car may still have the right of way.

One of them of course is if the car had the green and was too close to avoid the collision.

The wrongful death attorney should be able to advise the family about the case based on its facts and details.

Man Killed in Pedestrian Accident in Freeway Connector in San Jose

A pedestrian accident claimed one life Sunday evening when a man was hit by a pickup truck while trying to cross a freeway connector in San Jose.

According to the CHP, a man tried to walk across the connector from southbound Highway 87 to northbound Interstate 280 when he was struck by Chevrolet pickup truck.
The driver said that he tried to avoid the man but still hit him in the far right traffic lane.

It was still unclear why the man was trying to cross the connector in the first place.

The victim’s family could file a wrongful death claim against the driver but I doubt that it will be approved by his car accident insurance provider.

It is highly unlikely that the driver will be found liable because he had the right of way and there is no way that he could have reasonably known about the presence of the pedestrian.

The most important thing to find out about this case is the reason for the man’s presence in the connector.

I have a feeling that the answer will answer a lot of questions about the case.

Intoxicated Man Seriously Injured in San Diego Pedestrian Accident

An apparently intoxicated man was struck by a Jaguar in a pedestrian accident in San Diego last weekend.

According to San Diego Police, the unidentified man suddenly stepped out between two parked cars in an attempt to cross Federal Avenue.

He was struck by a Jaguar, which was driven by a 30-year-old man.

The man sustained serious head injuries and had to be brought to a hospital.

Most people would think that the intoxicated man is most likely liable in the accident, since he apparently sprung onto the traffic.

However, there are still insufficient details to make a conclusion.

Yes, the man was intoxicated and it could be an argument for comparative negligence.

But, the report did not specify if he was in a crosswalk and whether he had the right of way during the collision.

For all we know, the Jaguar may have been speeding that is why the driver did not notice the man.

Not saying that those are what happened, but we cannot disregard the possibility.

The point is that vehicle accidents should not be taken at face value; there could be details that would show the truth underneath the surface.

Long Beach Pedestrian Accident Critically injures One Person

A pedestrian accident in Long Beach critically injured a man yesterday morning.

According to Long Beach Police, the man was walking on a crosswalk in Orizaba Avenue when he was struck by a van.

The impact was so great that he ended up 30 feet from the car.

According to witnesses, the driver may not have seen the pedestrian because of the bright glare from the morning sun.

Regardless, it does not free the driver from liability.

The victim has two years to file a personal injury lawsuit against the driver.

The driver can argue that he did not see the man because of the bright sun but all drivers are required to approach crosswalks and intersections with caution.

If only the motorist approached the crosswalk with appropriate speed to react to an emergency then he would have spotted the man in time.

If that was the case he could have taken measures to avoid the collision.

Waging Timely Legal Action in your Pedestrian Accident Involvement

Another ruthless Pedestrian Accident have happened in California, just last Sunday Night, at about 9 p.m. at Hollywood Boulevard. This was reported by the CBS2.com with the heading, “Suspect Held On $1M Bail For Hitting Pedestrians”.

According to the news, a man and a woman, both Latinos, were fatally struck during a police pursuit of an alleged reckless driver. Both died at the scene of the accident at 6440 W. Hollywood Blvd., about two blocks west Vine Street.
Based on the witnesses’ recollection, the victims were holding hands and walking in a crosswalk when a vehicle stopped for a red light before suddenly lurching forward and striking them. The suspect was Sergio Delgado, which according to the witnesses appeared to be intoxicated.

Repeatedly, we are constantly experiencing endless cases of accidents of this sort. We cannot help but wonder why does accidents kept on besetting us, despite our wager of so many measures of safety. I am fully concerned with all these, and I assumed most of us also did, as we or any member of our family can potentially be a victim of this never-ending mishaps.

I can feel how gloomy it was for the surviving family of the victims who died for no valid reason. To them, I extend my condolences.

As an Attorney and a local in California, I considered this type of accident as one of the deadliest accident involvement anyone can have. I have handled a bunch of cases of this sort during my entire practice, which were all tragic and life destructive, though my clients have somewhat attained their deserved compensation.

All I can say for the victims as well as to their families and to those who may experience this type of accident that they should take immediate legal action against the erring culprit who may have caused their depressing situation. This is a must do for them in order to get compensated at the soonest time possible.
