UPDATE: Michael Jackson Wrongful Death Lawsuit Retrial Temporarily Denied

After losing their bid to hold AEG Live liable for Michael Jackson’s death last October, Jackson’s family is now facing another hurdle as a judge has tentatively rejected their request for a retrial.

According to recent news reports, the judge who presided over Michael Jackson’s wrongful death case has temporarily denied the family’s appeal filed last December.

Under the said motion for a new trial, lawyers for Katherine Jackson and the King of Pop’s three children, argued that the verdict used by the previous jury was faulty and that the presiding judge erred by refusing them to pursue a negligence claim separate from the hiring case.

Also, the said motion reportedly included sworn statements from four of the 12 jurors claiming that they feel cheated by the outcome of the case. The jurors allegedly blamed the case result on a misleading verdict form.

On the other hand, lawyers for AEG Live likewise filed statements from seven other jurors claiming that they were not confused by the verdict form.

In response, in a tentative ruling issued by the Los Angeles County Judge, Yvette Palazuelo, she affirmed that she did not err in her decision on the verdict form or with the dismissal of the negligence claim.

The tentative ruling was held earlier this month and Palazuelo is expected to issue a final decision soon.

Meanwhile, for the Jackson’s family, lawyers have indicated that they will once again appeal the jury’s verdict.

Apparently, things aren’t getting any better for the Jackson family. This might be their last shot, so they are prompted to try harder this time.

In Los Angeles, it is very important that you seek the best team of wrongful death lawyers. Also, preserving pieces of evidence to establish proof that a party has been negligent and caused death of your loved ones is very crucial. Therefore, always be mindful of every single steps of the way.

Michael Jackson Family Loses Bid in Wrongful Death Lawsuit

After a five-month legal battle, the family of the late Michael Jackson (MJ) lost their bid to hold the giant concert promoter, AEG Live, accountable for the King of Pop’s death.

Recent reports have it that Katherine Jackson is  devastated following the jury’s verdict on her son’s wrongful death case.

In the said verdict, the jury ruled that AEG Live indeed hired Conrad Murray, who gave the singer the fatal dose of the powerful anesthetic, Propofol. However, in a sudden rebound, the judge subsequently ruled that Murray was NOT unfit or incompetent to treat MJ at the time he was hired by the concert promoter.

Katherine Jackson along with MJ’s children sued AEG Live, claiming the company negligently hired and supervised Murray to care for the pop icon while preparing for his comeback concert billed “This Is it”.

According to a source, when asked why the jury sided with AEG, the jury claimed that although the singer’s death was a tragedy for everyone, no one from the concert promoters was responsible for his death.

What went between MJ and Murray later on was a secret to all. The jury also believed that Murray simply submit to his famous patient’s demands, according to an insider. Also, the judge apparently believed that although the singer’s death was a tragedy to all, MJ himself was responsible for his own fate, reports said.

It could be remembered that it was only last month when news reports claimed that the said lawsuit could finally head to jury. Now that it has finally reached the jury and that AEG Live has been acquitted from the case, the Los Angeles wrongful death lawyer herein speculates that there may have a chance that the Jackson family will appeal the case. However, the process would probably take years, he said.
