Prevent Auto Accidents

Some drivers just don’t know how to share the road with pedestrians. They drive furiously without taking due regard for the safety of other people.

However, it is also our duty as pedestrians to take caution, especially when crossing the streets.
Here are solutions to prevent road-side injuries:

  1. Use the side of the road where cars are coming opposite you. That way, you can see if the vehicle is about to hit you. You can also have a chance to avoid it;
  2. Walk or jog during the day or where roads are properly lit.
  3. Before crossing, stop first and look both sides for approaching vehicles. Use the pedestrian lane when crossing.
  4. When walking or jogging at night or on dark areas, it is advisable to have a reflector with you so that the cars can see you as they pass by.
  5. As much as possible, use the sidewalks or joggers’ lane in order to prevent car-related injuries.
  6. Avoid walking on the streets when under the influence of alcoholic beverages or addictive drugs.
  7. Avoid walking alone.

Flourishing Claim on Pedestrian Injury

Pedestrian injury has long been recognized as one of the leading causes of death not only among adults but especially among school-aged children.

Pedestrian injuries are often caused by vehicular accidents, trip and fall and premise liability.

Annually, doctors treat thousands of patients injured by motor vehicles while walking or crossing the streets. In fact the National Safety Council reports that more than 5,000 pedestrians are killed by vehicles every year and about one-third of these victims are children.

Just a week ago, another fatal pedestrian accident happened, which claimed a life of an unidentified homeless woman.

If this accident happened in California, the heirs of the deceased may have the right to sue only if it has been proved that said pedestrian has the right of way.

Being an every day road user myself, I cannot blame other drivers why pedestrian injury happens. Other pedestrian are so reckless or too eager to cross the street that they ignore traffic rules.

To avoid injury or death, pedestrians should be reminded of the following:


  • Use the sidewalks
  • Comply with traffic rules
  • Cross the streets by using the crosswalks or designated crossings
  • Always look to the left and right before crossing
  • When crossing or walking with children, closely watch them and explain to them the safety rules

A Fraudulent Slip and Fall Case

A slip and fall accident generally refers to a situation whereby person slips and falls or trips and falls due to a dangerous condition on someone else's property and is injured as a consequence.

These accidents are caused by slippery floors, uneven steps or broken handle bars. Whatever the cause is, the bottom line is, the property owner may be held liable for the resulting injuries.

But what about in case of a sham slip and fall? Will it make the owner liable?

Astonishingly and to my dismay, a fraudulent claim for a trip and fall happened against a grocery owner allegedly for injuries sustained by the customer. Lucky for the owner, he had installed in his grocery store a surveillance camera. Surprisingly or unsurprisingly, the said customer plotted her scheme of make belief.

Now back to my question, can the customer maintain a slip and fall case against the grocery owner?

Of course not! The customer alone bears whatever losses she incurred for curing her injuries.

Remember, a claim for slip and fall accident will only ensue if the building or property owner has been negligent in the care and maintenance of the premises.

In this case, the injuries were sustained due to her deliberate and fraudulent role play of a slip and fall victim. This is not only a desperate move but must be punished.
