Intoxicated Man Seriously Injured in San Diego Pedestrian Accident

An apparently intoxicated man was struck by a Jaguar in a pedestrian accident in San Diego last weekend.

According to San Diego Police, the unidentified man suddenly stepped out between two parked cars in an attempt to cross Federal Avenue.

He was struck by a Jaguar, which was driven by a 30-year-old man.

The man sustained serious head injuries and had to be brought to a hospital.

Most people would think that the intoxicated man is most likely liable in the accident, since he apparently sprung onto the traffic.

However, there are still insufficient details to make a conclusion.

Yes, the man was intoxicated and it could be an argument for comparative negligence.

But, the report did not specify if he was in a crosswalk and whether he had the right of way during the collision.

For all we know, the Jaguar may have been speeding that is why the driver did not notice the man.

Not saying that those are what happened, but we cannot disregard the possibility.

The point is that vehicle accidents should not be taken at face value; there could be details that would show the truth underneath the surface.

Toyota Recent Recalls Focus on Gas Pedals

A series of problems regarding the late models of Toyota prompted recalls where the most recent one is focused on fixing the reported sticking accelerator pedals.

Toyota Motors Corp. issued the recent recalls after receiving reports of worn and stuck pedal mechanism that can cause vehicle collisions and other road accidents that threatens the lives of motorists.

Toyota vehicle models included in the recalls are the 2009-2010 Corolla, RAV4, and Matrix, the 2007-2010 models of Camry and Tundra, the 2005-2010 Avalon, the 2008-2010 Sequioia, and the 2010 Highlander.

The recent recalls preceded Toyota’s recall of about 4.2 million vehicles because of problems with the gas pedals that get stuck because of defective floor mats.

Product liability holds the company responsible for any damages incurred because of their negligence in keeping their products safe for the public use.

These recalls will certainly take a hit in the company’s reputation and financial stability which only proves the importance of conducting tests and quality checks before releasing the product to the market.

Route 79 Motorcycle Accident Victim Identified by Coroner’s Office

The Riverside Coroner’s Office has identified the man who died in a motorcycle accident on Route 79 the other day as John Anderson, 62, from Encinitas.

According to CHP, Anderson was riding his motorcycle on the southbound lane of Route 79 when he tried to overtake the vehicle in front of him.

As a result, he collided head-on with a semi-truck as he entered the northbound lane.
Anderson was pronounced dead at the scene of the accident.

It looks like the liable party in the accident is Anderson himself as he was on the wrong lane when he collided with the truck.

Even if Anderson has died, the truck driver can still make a claim for the damages sustained from the accident.

Although Anderson’s death freed him from criminal liability, the truck driver can still go after him civilly to get back what he lost.

However the truck driver can only make a claim up to the limit of Anderson’s policy and probably even some of his assets.

If the amount of damages goes beyond that, he won’t be able to collect anymore.

Chrysler to Recall 24,000 Vehicles with Possible Defective Brake System

Vehicle safety is the responsibility of vehicle manufacturing companies. Failing to fulfill this obligation may cause the company to recall the specific line of vehicle in question to avoid future accidents.

In fact, National Highway Traffic Safety Administration (NHTSA) stated that Chrysler will recall around 24, 177 vehicles from its Dodge, Chrysler, and Jeep lines to address an issue that can cause brake failure.

Vehicles that will be affected by such recall include 2010 models of Sebring, Avenger, Liberty, Grand Cherokee, Nitro, Commander, and 2009-2010 model of Ram.

According to NHTSA the following models “may have been built with an improperly formed or missing brake booster input rod retaining clip.”

This problem can lead to a brake failure, which can trigger an accident.

As a way of addressing the problem, Chrysler will replace the vehicles’ input rod retaining clip for free.

The process of recalling vehicles and correcting possible defects that they possess can be expensive and time consuming for vehicle manufacturing companies. Making sure that a vehicle and its parts are efficiently designed and produced may be a way to save companies from conducting recalls. In addition, it will also prevent the possible occurrences of deadly accidents.

4 People Injured in 101 Freeway Chain Accident

Four people, including a two-year-old boy, were seriously injured yesterday morning in a chain accident in the 101 freeway near Encino.

All injured parties were sent to a nearby hospital and are expected to survive.

The injured parties should immediately inform their car accident insurance providers, and hire the services of a good car accident attorney.

The problem with multi-vehicle car accidents is that it is difficult to say who started the whole collision.

A car accident attorney would be able to guide the victims through the process and give them realistic expectations.

Their lawyers should also be able to represent them in the negotiations with the insurance companies so they will not get the short end of any settlement.

Long Beach Pedestrian Accident Critically injures One Person

A pedestrian accident in Long Beach critically injured a man yesterday morning.

According to Long Beach Police, the man was walking on a crosswalk in Orizaba Avenue when he was struck by a van.

The impact was so great that he ended up 30 feet from the car.

According to witnesses, the driver may not have seen the pedestrian because of the bright glare from the morning sun.

Regardless, it does not free the driver from liability.

The victim has two years to file a personal injury lawsuit against the driver.

The driver can argue that he did not see the man because of the bright sun but all drivers are required to approach crosswalks and intersections with caution.

If only the motorist approached the crosswalk with appropriate speed to react to an emergency then he would have spotted the man in time.

If that was the case he could have taken measures to avoid the collision.

Firefighter injured by hit-and-run driver in Laguna Beach

Being a firefighter for 15 years, Luke Perisin has helped countless injured victims of car accidents, rescuing and taking people to safety.

Little did he know that the day will come when he will be on the side of the injured victim who needed rescuing.

Just last weekend, Perisin was struck by a hit-and-run driver while walking on the crosswalk at the intersection of South Coast Highway and Brooks Street.

According to police, the suspected driver was on the southbound lane of South Coast Highway when he suddenly crossed over the other lane and struck Perisin.

Perisin hit the windshield and was sent 50 feet into the air.

He sustained head injuries and numerous broken bones.

Authorities are now looking for a white Toyota Prius or Corolla with front end damage and probably busted windshield.

The hit-and-run driver, aside from being charged with a personal injury lawsuit will also be prosecuted for leaving an accident scene.

Under the law, motorists are required to stay after an accident until the time that we are cleared by proper authorities.

We are also required to exchange information with the other parties involved and provide assistance to those who are injured.

Hopefully this driver will be caught soon so he can answer to what he has done.

Pomona Man Survives Rollover Accident

A Pomona man miraculously survived a rollover accident on the 57 Freeway without major injuries.

According to police, the crash was caused by a flat back tire, which was already worn out and bald.

Cuong Thach said he was saved by God as he was praying the whole time his Toyota 4Runner was rolling.

I’m sure that it’s true but if he was wearing a seatbelt during the car accident, that probably helped too.

Most of us take seatbelts for granted but it actually saves us from the number one cause of death in rollover accidents, which is car ejection.

According to experts, a driver reduces the risk of serious injury or death by about 70% by wearing a seatbelt.

In fact a properly-working seatbelt is one of the safety requirements that manufacturers should consider when designing a car, which is also a similar requirement under state and federal laws.

The state of California requires all people, whether you are a passenger or a driver, to wear seatbelts whenever riding a vehicle.

So if you wear your seatbelt, not only are you keeping yourself safe, you are also following the law.

Woman Charged with Vehicular Manslaughter after Jan 2 Motorcycle Accident

Most of the time, we realize our mistake a little too late.

Heather Anne Baxter, 24, of Antioch was charged with one count of felony and one count misdemeanor vehicular manslaughter following a motorcycle accident last January 2.

According to reports, Baxter’s Honda Accord struck the Suzuki DRZ 400 motorcycle that Jeffrey Cramer, 50, was riding on the southbound lane of Highway 87.

Cramer was thrown off his bike and responding firefighters declared him dead on the scene.

Baxter was said to be running at about 70mph and was not able to stop or decelerate in time to avoid hitting Cramer.

She did stay on the scene and even called 911.

Baxter was said to be profoundly saddened and upset about the whole ordeal.

The family of the victim said that they had mixed feelings about the arrest.

On one hand, they were relieved that the liable party for Cramer’s death was apprehended as opposed to it being ruled as a single crash earlier.

But on the other, they feel sad for Baxter that she has to live with the fact that she caused the death of another person, albeit unintentional.

If they choose to support the prosecution of Baxter or not will be up to them, the state can move forward with the case with or without their support.

They know that Baxter is already suffering for what she has done but they can’t just “not do” anything about the death of their loved ones.

In my opinion, filing a wrongful death lawsuit is the closest thing that would compromise those feelings.

By filing the lawsuit against Baxter they at least, in their own way, may hold her accountable (at least civilly) for her actions.

OC Man Dies in Rollover Crash

Authorities have identified 37-year-old Alen Nazarian as the latest victim of a rollover crash along Interstate-5.

Reports indicate that the man suddenly lost control of the vehicle as he was heading north near the border patrol checkpoint causing it to rollover several times before landing onto the shoulder lane.

The California Highway Patrol suspected that the driver may have been intoxicated at the time of the crash.

Drivers should know better than to risk their safety by driving after drinking. Everyone should keep in mind that they can take away lives senselessly just by driving under the influence of alcohol or drugs and so it should never be practiced.

Bus Crash Hurts Motorist

A driver was hurt in El Cajon after the vehicle he was riding hit a bus that was heading west on Douglas Avenue.

Reports indicate that the vehicle driven by the injured motorist was pulling out near the intersection of Douglas and Van Houten avenues when he was struck by the bus.

The vehicle was said to be heading south.

When pulling out, drivers must survey oncoming traffic so they can determine whether there is an approaching vehicle and safely avoid it.

Bus accidents are especially risky to drivers of smaller vehicles as they are more prone to incurring serious injuries as they go up against a bigger and more powerful vehicle.
